These Terms & Conditions (“Terms”) govern your use of thehavenember.com and your purchase, reservation, or participation in experiences, services, or offerings coordinated by The Haven Ember (“The Haven Ember,” “we,” “us,” or “our”).
By accessing our website, submitting an inquiry, making a reservation or payment, or participating in a Haven Ember experience, you acknowledge and agree to these Terms, together with our Privacy Policy, Refund & Cancellation Policy, and any additional booking agreement or terms provided to you.
If you do not agree to these Terms, please do not use our website or purchase our services.
1. About The Haven Ember
The Haven Ember provides luxury postpartum hospitality, lifestyle, recovery-support, and related concierge experiences.
Experiences may include or coordinate accommodations, postpartum doula support, dining, wellness and spa services, photography, nursery design, celebrations, and other hospitality or lifestyle services.
Specific inclusions depend upon the experience purchased and will be identified in the applicable proposal, reservation confirmation, or booking agreement.
2. Important Medical Disclaimer
The Haven Ember is not a hospital, medical facility, medical practice, birthing center, nursing service, or healthcare provider.
The Haven Ember does not diagnose, treat, cure, prevent, or manage medical conditions and does not provide medical advice.
Information provided through our website, communications, staff, contractors, partners, or experiences is not intended to substitute for advice, diagnosis, treatment, or care from a licensed physician or other qualified healthcare professional.
Guests remain responsible for maintaining an appropriate relationship with their own physicians, pediatricians, obstetric providers, and other healthcare professionals.
Medical Emergencies
If you, your baby, or another person experiences or may be experiencing a medical emergency, call 911 or seek immediate medical attention.
Do not rely on The Haven Ember, a hotel, doula, concierge, or other non-medical service provider to diagnose or treat an emergency.
3. Postpartum Doula Services
Postpartum doulas provide non-medical support unless a particular individual is separately licensed to provide healthcare services and is expressly engaged in that professional capacity.
Doula services may include education, emotional support, newborn-care assistance, household or recovery support, and other non-clinical services within the provider’s scope.
Doula services do not replace medical, nursing, pediatric, psychiatric, psychological, or other licensed healthcare services.
4. Parent and Guardian Responsibility
Parents and legal guardians retain responsibility for their baby or child throughout a Haven Ember experience.
Unless expressly provided otherwise in a separate written agreement, The Haven Ember does not assume legal custody or guardianship of a child.
Parents and guardians are responsible for making decisions concerning their child’s feeding, sleeping, care, health, safety, medications, and medical treatment.
Guests should communicate any concerns regarding a newborn’s or parent’s health directly to an appropriate licensed healthcare professional.
5. Eligibility and Reservations
You must be at least 18 years old and legally capable of entering into a binding agreement to make a reservation.
Reservations are subject to availability and are not confirmed until required payments have been received and written confirmation has been issued.
Submitting an inquiry does not guarantee availability, pricing, accommodations, or services.
6. Pricing and Payment
Pricing is based on the experience, stay length, accommodation category, services, availability, season, and other factors applicable at the time of booking.
Unless expressly stated otherwise, prices may change before a reservation is confirmed.
Guests are responsible for paying all amounts according to the payment schedule provided with their reservation.
Additional services, upgrades, extensions, special requests, damages, or purchases may result in additional charges.
7. Hotel Accommodations
Hotel accommodations coordinated through The Haven Ember remain subject to hotel availability and the hotel’s rules, policies, and operating requirements.
A particular room number, floor, view, connecting configuration, suite location, or other hotel feature is not guaranteed unless expressly confirmed in writing.
Hotel inventory and operations may change for reasons outside The Haven Ember’s reasonable control.
Guests are also responsible for complying with applicable hotel rules and policies during their stay.
8. Independent Third-Party Providers
The Haven Ember experience may incorporate services provided by independently owned and operated third parties, which may include:
- Hotels
- Postpartum doulas or support professionals
- Restaurants and food-service providers
- Massage therapists
- Spas and wellness providers
- Photographers
- Transportation providers
- Interior designers and vendors
- Event professionals
- Beauty professionals
- Other hospitality or lifestyle service providers
Where a provider is an independent contractor or independent third-party business, that provider is responsible for its own professional services, acts, omissions, licensing, insurance, personnel, and compliance with applicable law.
Nothing in these Terms is intended to characterize an independently operated provider as an employee, agent, partner, or joint venturer of The Haven Ember where no such relationship legally exists.
Third-party services may also be governed by the provider’s own terms, waivers, cancellation policies, and privacy practices.
9. Wellness, Massage & Spa Services
Participation in massage, spa, beauty, fitness, wellness, or similar services is voluntary.
Guests are responsible for determining, in consultation with their healthcare provider when appropriate, whether a particular service is suitable for them.
Guests should disclose relevant allergies, sensitivities, pregnancy or postpartum considerations, injuries, restrictions, or other information directly to the applicable provider before receiving a service.
The Haven Ember does not make medical determinations regarding whether a guest is medically suitable to participate.
10. Food, Allergies & Dietary Requirements
Guests are responsible for informing The Haven Ember and the applicable food-service provider of known allergies, dietary restrictions, and other relevant requirements.
Food may be prepared by independently operated restaurants, hotels, caterers, or other providers.
Although reasonable efforts may be made to communicate dietary requests, The Haven Ember cannot guarantee an allergen-free environment or prevent cross-contact by independent food-service providers.
Guests with serious allergies should discuss appropriate precautions directly with the applicable provider and their healthcare professional.
11. No Guaranteed Outcomes
The Haven Ember is designed to provide an elevated and supportive postpartum experience.
However, we do not guarantee any particular medical, physical, emotional, developmental, breastfeeding, lactation, sleep, recovery, wellness, relationship, or other outcome for a guest or child.
Testimonials, photographs, descriptions, marketing materials, and examples represent individual experiences and are not promises of future results.
12. Assumption of Ordinary Risks
Participation in optional hospitality, wellness, dining, transportation, photography, events, and other activities may involve risks inherent to those activities.
By voluntarily participating, guests acknowledge and accept the ordinary and reasonably foreseeable risks inherent in the activities they choose to participate in, except to the extent responsibility for a particular risk cannot legally be limited or waived.
Nothing in these Terms requires a guest to participate in an optional activity.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE HAVEN EMBER AND ITS OWNERS, OFFICERS, EMPLOYEES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE WEBSITE OR THE HAVEN EMBER EXPERIENCE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE HAVEN EMBER’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE OR RESERVATION WILL NOT EXCEED THE AMOUNT ACTUALLY PAID DIRECTLY TO THE HAVEN EMBER FOR THE PORTION OF THE SERVICE GIVING RISE TO THE CLAIM.
These limitations do not apply where liability cannot lawfully be excluded or limited.
Nothing in these Terms is intended to disclaim liability that applicable law prohibits The Haven Ember from disclaiming.
14. Third-Party Acts and Services
To the extent permitted by applicable law, The Haven Ember is not responsible for acts, omissions, professional judgments, products, or services of independent third-party providers that are outside The Haven Ember’s control.
This provision does not waive any responsibility The Haven Ember may have under applicable law for its own conduct.
15. Personal Property
Guests are responsible for safeguarding personal belongings, valuables, jewelry, electronics, documents, and other property.
Lost or stolen property occurring within hotel premises may also be governed by the applicable hotel’s policies and applicable law.
The Haven Ember is not responsible for loss, theft, or damage caused by circumstances outside its reasonable control, except where responsibility cannot legally be excluded.
16. Guest Conduct and Safety
Guests are expected to behave respectfully toward staff, providers, hotel personnel, other guests, and property.
The Haven Ember may discontinue or refuse services when reasonably necessary because of threatening, abusive, illegal, dangerous, or materially disruptive behavior.
Where services are discontinued because of a guest’s material misconduct, refunds are not guaranteed and remain subject to applicable law and our Refund & Cancellation Policy.
17. Changes to Experiences
The Haven Ember may occasionally need to substitute or modify an accommodation, provider, amenity, product, meal, appointment, or other component because of availability, emergencies, operational requirements, or circumstances outside our reasonable control.
When reasonably possible, we will attempt to provide an alternative of comparable quality or value.
18. Cancellations, Refunds & Date Changes
Reservations are subject to our Refund & Cancellation Policy and any additional cancellation provisions contained in the guest’s booking agreement.
Because childbirth timing is inherently unpredictable, requests to adjust postpartum stay dates will be handled in accordance with that policy and remain subject to accommodation and provider availability.
19. Force Majeure
The Haven Ember will not be responsible for delays, modifications, interruptions, or inability to perform caused by events beyond its reasonable control, including severe weather, natural disasters, fire, governmental actions, public-health emergencies, labor disruptions, utility or technology failures, transportation disruptions, hotel closures, provider emergencies, or similar events.
Where such an event occurs, The Haven Ember will make reasonable efforts to determine an appropriate alternative, rescheduling arrangement, or other resolution based on the circumstances and any non-refundable third-party commitments.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless The Haven Ember and its owners, officers, employees, and representatives from third-party claims, damages, liabilities, losses, and reasonable expenses arising from your unlawful conduct, material breach of these Terms, intentional misconduct, or violation of another person’s rights.
This provision does not require you to indemnify The Haven Ember for liability that applicable law does not permit The Haven Ember to transfer to you.
21. Website Information
We make reasonable efforts to keep information on our website accurate and current.
However, photographs, descriptions, prices, amenities, providers, availability, and other information may change.
Website content does not constitute a guarantee unless expressly incorporated into a confirmed written reservation or agreement.
22. Intellectual Property
Unless otherwise stated, the content of thehavenember.com, including The Haven Ember name, branding, text, graphics, logos, design elements, photographs, videos, website design, and original materials, is owned by or licensed to The Haven Ember and is protected by applicable intellectual-property laws.
You may not reproduce, distribute, modify, sell, commercially exploit, or use our protected content without prior written permission.
23. Photography and Guest Likeness
Purchasing or participating in a Haven Ember experience does not, by itself, grant The Haven Ember unrestricted permission to use a guest’s image or likeness for advertising.
When The Haven Ember wishes to use identifiable guest photographs, video, testimonials, or other personal content for promotional purposes, appropriate permission or a separate media release may be requested.
24. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
By providing information necessary to coordinate your experience, you acknowledge that certain information may need to be shared with appropriate service providers to fulfill your requests, subject to applicable privacy requirements.
25. Electronic Communications
By providing an email address or telephone number, you consent to receiving communications reasonably necessary to administer your inquiry, reservation, or experience.
Marketing communications are subject to applicable consent requirements and available opt-out rights.
26. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
27. Disputes and Venue
Before commencing formal legal proceedings, you and The Haven Ember agree to make a good-faith effort to resolve disputes through written communication.
Unless applicable law requires otherwise or a separate signed agreement establishes another lawful dispute-resolution procedure, legal proceedings arising from these Terms will be brought in a court of competent jurisdiction in Texas in the county designated in the applicable booking agreement or, if none is designated, in a county where venue is otherwise legally proper.
28. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, while the remaining provisions will remain in effect.
29. No Waiver
Failure by The Haven Ember to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
30. Entire Agreement
These Terms, our Privacy Policy, Refund & Cancellation Policy, and any applicable signed booking agreement constitute the terms applicable to your relationship with The Haven Ember concerning the relevant services.
If a signed booking agreement contains terms that conflict with these website Terms regarding a specific reservation, the signed booking agreement will control to the extent of that conflict.
31. Changes to These Terms
We may update these Terms periodically.
The “Last Updated” date will identify the most recent version. Changes will apply prospectively as permitted by applicable law and will not retroactively alter a confirmed reservation where prohibited by law.
